Marquantex LLC, a California limited liability company (“Marquantex,” “we,” “us,” or “our”), operates Backtested Strategies™ (“BTS”) and backtestedstrategies.com. This Privacy Policy explains the categories of personal information we collect, how we use and disclose that information, and the choices that may be available to you when you use BTS websites, accounts, memberships, tools, communications, and related services (collectively, the “Services”).

1) Information we collect

Depending on how you use the Services, we may collect the following categories of information:

  • Account and contact information, such as your name, email address, username, account profile information, and information you provide through forms or communications with us.
  • Membership and transaction information, such as membership level, entitlement status, order and subscription identifiers, billing name and contact information, billing address, order totals, payment status, payment processor references, card brand or type, masked card information such as the last four digits, and card expiration information retained by our membership system.
  • Product settings and operational information, such as saved UMT Default ticker, Historical Performance display preference, UMT alert preference, entitlement information, and limited technical state used to prevent duplicate alerts or operate requested product features.
  • Marketing and communication information, such as email marketing consent or withdrawal, consent timestamps, email address, name, communications with us, and engagement information associated with BTS marketing campaigns where enabled by the applicable provider settings and consent configuration.
  • Technical, security, and usage information, which may include IP address, device and browser information, authentication events, pages or resources requested, timestamps, referring pages, diagnostic information, fraud or abuse signals, and information commonly recorded by hosting, security, content-delivery, or server systems.
  • Cookie and browser-storage information used for functions such as authentication, security, preferences, payment processing, site operation, and aggregated measurement. Additional information appears in our Cookie Policy.

We may combine information collected through different parts of the Services when reasonably necessary to operate an account, administer a membership, provide access, maintain security, or perform another purpose described in this Policy.

2) How we use information

We may use personal information to create and administer accounts; authenticate users; determine membership and feature entitlements; process and administer purchases, renewals, cancellations, and billing records; provide requested BTS tools, settings, alerts, and communications; respond to inquiries; maintain and secure the Services; prevent fraud, abuse, credential sharing, and unauthorized access; troubleshoot and improve site operation; maintain records; enforce our agreements and intellectual-property rights; comply with legal obligations; and establish, exercise, or defend legal claims.

We may also use account, membership, and entitlement information to display BTS plan information, product availability, feature comparisons, upgrade opportunities, or other first-party BTS offers within the Site or account dashboard. We do not use your account or membership information to make UMT or other BTS model outputs individualized to your personal portfolio, suitability, or financial circumstances.

3) Memberships and payments

BTS uses third-party membership and payment-service infrastructure to administer paid plans. Our membership records may retain order, subscription, billing, masked payment-reference, and transaction information used to administer the membership and maintain business records. Payment transactions are processed by third-party payment providers, which may collect and process payment credentials under their own terms and privacy practices.

We may retain records of checkout consent, including information linking a user and order to the Terms of Use page and modification state presented at checkout, and other records needed to administer automatic-renewal or subscription obligations.

4) UMT settings and service communications

When you use UMT, BTS may retain account-level settings needed to operate the product, including your saved Default ticker, Historical Performance display preference, UMT alert preference, and limited alert-processing state. UMT uses your current BTS account email address when sending enabled alerts.

Account, billing, renewal, cancellation, security, and requested product communications are service communications and are separate from marketing consent. UMT alerts are optional service communications controlled through the applicable UMT setting. BTS does not use UMT alert emails for promotions, upgrades, pricing offers, cross-sells, or other marketing content.

5) Marketing communications and measurement

BTS uses marketing-consent status and applicable unsubscribe or suppression controls when determining eligibility for BTS marketing email. Marketing messages include an unsubscribe mechanism. Withdrawing marketing consent does not prevent us from sending non-marketing communications that are reasonably necessary to administer an account, membership, transaction, security matter, or product feature you requested.

BTS uses third-party email and marketing-service providers to administer marketing lists and campaigns. Depending on provider configuration and the recipient’s tracking-consent state, marketing campaigns may use open, click, or similar engagement measurement. BTS practices are designed so that unknown contact-level tracking consent is not treated as permission for identified contact tracking. Provider settings and measurement methods may change over time.

Our email and marketing-service providers may receive contact information needed to administer the marketing relationship, such as email address and name. Depending on configuration, limited membership-status and consent fields may also be provided. We do not provide UMT ticker/settings or payment-card information to those providers for marketing-list administration.

6) Cookies, analytics, and browser signals

The Services may use cookies, local storage, and similar technologies for authentication, account preferences, security, abuse prevention, payment processing, performance, and site measurement. We use third-party infrastructure and service providers for functions such as content delivery, security, abuse prevention, and aggregated site measurement. We do not use third-party advertising or retargeting on the Site.

BTS does not sell personal information or share personal information for cross-context behavioral advertising. The Site is not designed around legacy browser “Do Not Track” signals as a separate advertising preference because BTS does not operate behavioral advertising on the Site. If a privacy law applicable to Marquantex requires recognition of a legally valid opt-out preference signal for a particular data practice, we will process that signal as required by that law.

Third-party infrastructure, security, payment, or other service providers may receive technical information when you interact with the functions they provide. We do not engage third-party advertising networks to collect BTS Site activity for behavioral advertising across unrelated websites.

7) How we disclose information

We may disclose information to vendors and service providers that perform functions for Marquantex, including website hosting, content delivery, security, abuse prevention, payment processing, membership administration, email delivery, marketing-list administration, analytics, technical support, and related infrastructure. Those providers may process information as necessary to perform the services for which they are engaged.

We may also disclose information when we reasonably believe disclosure is necessary to comply with law, regulation, subpoena, court order, or other legal process; protect the rights, property, or safety of Marquantex, our users, service providers, or others; investigate or prevent fraud, abuse, security incidents, or violations of our terms; establish or defend legal claims; or complete a merger, financing, reorganization, sale of assets, acquisition, bankruptcy, or similar business transaction.

8) Sale, sharing, and targeted advertising

Marquantex does not sell personal information and does not share personal information for cross-context behavioral advertising as those concepts are defined under California privacy law. BTS does not operate an advertising-network or retargeting program on the Site.

9) Retention

We retain information for as long as reasonably necessary for the purposes for which it was collected or another legitimate business purpose described in this Policy, including account and membership administration, transaction records, security, fraud prevention, legal compliance, dispute resolution, enforcement, and the establishment or defense of legal claims. Some records may be retained for longer periods where required or permitted by law. Retention periods may also depend on the systems and configurations of our service providers.

Account closure, membership termination, or submission of a privacy request does not necessarily result in immediate deletion of all information. Information may be retained where applicable law permits or requires retention or where it remains reasonably necessary for legitimate business, security, accounting, fraud-prevention, enforcement, or legal purposes.

10) Security

Marquantex and its service providers use administrative, technical, and operational measures intended to protect the Services and information handled through them. No website, transmission method, account system, or storage system can be guaranteed to be completely secure. You are responsible for protecting your account credentials and for notifying us if you believe your account has been compromised.

11) Your choices and privacy requests

You may update certain account information through available account controls. You may unsubscribe from BTS marketing emails using the unsubscribe mechanism provided in those messages. You may change UMT alert preferences through the applicable UMT settings.

Depending on the law applicable to Marquantex and to your request, you may have rights concerning access to, correction of, deletion of, or other treatment of personal information. You may submit a privacy request through our Contact BTS page. We may take reasonable steps to verify the requester’s identity or authority before acting on a request and may deny, limit, or retain information where applicable law permits or requires us to do so.

Marquantex is a California company, but the applicability of particular privacy statutes may depend on statutory thresholds, the nature of the processing, the location of the individual, and other legal requirements. Nothing in this Policy voluntarily subjects Marquantex to a privacy statute that would not otherwise apply.

12) Minors

BTS accounts and memberships are intended for adults age 18 or older. The Services are not directed to children, and Marquantex does not knowingly solicit personal information from children. If you believe a child has provided personal information to us in circumstances prohibited by applicable law, contact us so that we can review the matter.

13) International users

Marquantex operates from the United States. If you access the Services from another country, information may be processed in the United States and in other countries where service providers operate. Privacy and data-protection laws may differ from those in your location. Where a law applicable to Marquantex requires a particular transfer mechanism or privacy right, Marquantex will address that requirement as applicable.

14) Third-party sites and services

The Services may link to or interact with third-party sites or services. Marquantex does not control the independent privacy or security practices of those third parties. Information you provide directly to a third party is subject to that third party’s terms and privacy practices.

15) Changes to this Privacy Policy

We may update this Privacy Policy as the Services, providers, practices, or applicable requirements change. We will update the “Last updated” date and provide any additional notice required by applicable law. Changes to contractual rights and obligations are governed by the Terms of Use.
